2. Platform Services

METASHAPES is a digital marketplace offering curated 3D model files for purchase under various license types. We act as the seller, broker and license issuer for all products listed on the Platform.

3. User Accounts

3.1. To make purchases, you must create a free account using a valid email address.

3.2. You are responsible for maintaining the confidentiality of your account credentials.

3.3. You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and make purchases.

3.4. METASHAPES reserves the right to suspend or terminate accounts that violate these Terms.

4. Products and Purchases

4.1. All products sold on the Platform are digital files. No physical goods are delivered.

4.2. Prices are displayed in USD andare subject to change without notice. The price at the time of purchase is binding.

4.3. All purchases are final. Due to the digital nature of the products, we do not offer refunds once a file has been downloaded. In the event of a verified technical defect, we will offer a replacement or store credit at our discretion.

4.4. You will receive an email confirmation and download access immediately after a successful payment.

5. Licenses

5.1. Upon purchase, METASHAPES grants you a limited, non-transferable license to use the purchased 3D model file in accordance with the license type selected at checkout.

5.2. Available license types are Personal Use, Commercial Use, Resell Rights, and Exclusive License. Full terms for each license type are described on the License Overview page and form part of these Terms.

5.3. Licenses are granted to the purchasing account holder only and may not be transferred, sublicensed, or sold to third parties.

5.4. Models sourced under Creative Commons licenses are subject to additional conditions as specified by the applicable CC license. Attribution requirements, where applicable, are listed on the product page and could be included in the download package.

5.5. METASHAPES does not guarantee that any particular use case is permitted under a given license. It is your responsibility to verify that your intended use complies with all license terms.

6. Intellectual Property

6.1. The METASHAPES Platform, including its design, branding, curation, and software, is the intellectual property of METASHAPES.

6.2. 3D model files in the catalog are created by us, third-party artists and organizations. The rights belong to the respective creators, unless they have been assigned or made available under an open license (such as Creative Commons). The creator is listed on each product page.

6.3. You may not reproduce, redistribute, or publicly display the Platform’s content (excluding your legitimately licensed downloads) without written permission.

7. Prohibited Uses

You agree not to:

• Resell, redistribute, or sublicense purchased files in violation of the applicable license terms
• Reverse-engineer, copy, reproduce, decompile, or extract proprietary data from the Platform
• Use automated tools to scrape, copy, or download content from the Platform without written consent
• Upload or submit any content that infringes third-party intellectual property rights
• Attempt to circumvent any security or access controls on the Platform
• Use the Platform for any unlawful purpose
• Use the content for AI training without specific written permission.

8. Third-Party Content and Attribution

As a meta-platform the models in our catalog originate primarily from third-party creators. Some are sourced under Creative Commons or equivalent open licenses. METASHAPES provides attribution information as required by the applicable licenses. We make reasonable efforts to ensure accuracy but cannot guarantee completeness of attribution data in all cases.

9. Disclaimer of Warranties

The Platform and all products are provided ‘as is’ and ‘as available’ without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that files are free from errors, defects, Trademark or legal violations or that they will meet your technical requirements.

10. Limitation of Liability

To the maximum extent permitted by applicable law, METASHAPES shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform or the purchased files. Our total liability for any claim shall not exceed the amount paid by you for the relevant product.

11. Indemnification

You agree to indemnify and hold METASHAPES harmless from any claims, damages, or costs (including legal fees) arising from your violation of these Terms, uploaded or downloaded files or misuse of purchased licenses.

12. Changes to Terms

METASHAPES reserves the right to update these Terms at any time. Updated Terms will be published on this page with a revised ‘Last Updated’ date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Any disputes shall be subject to the exclusive jurisdiction of the courts of St. Gallen, Switzerland.
